1. Introduction
Welcome to Excavation Services by JKoschara LLC (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, communications, and services. By accessing or using our website or engaging with our services, you agree to these Terms.
2. Services Provided
We offer professional land clearing, grading, excavation, demolition, and related site preparation services. All estimates, agreements, and services are subject to written approval and signed documentation between the client and Excavation Services by JKoschara LLC.
Opt-in consent is obtained when customers call us, text us first, or submit a request form via our website, Facebook page, or Google Business Profile. By initiating contact, you agree to receive communications related to your inquiry or project, including SMS/Text messages, phone calls, or emails.
3. Payments and Billing
Payment terms will be outlined in each contract or invoice.
Payment is due as specified in your work agreement or invoice.
Late fees may apply if payment is not received by the due date.
We accept cash, check, or wire transfer unless otherwise stated.
Returned checks may be subject to additional fees.
4. Estimates and Project Scope
All estimates are based on the information available at the time and may change if conditions or scope differ from initial assessments. Any additional work or materials not included in the original estimate may result in additional charges.
5. Liability and Damages
We are not responsible for unmarked utilities, irrigation systems, or underground lines not properly located prior to work.
Clients are responsible for ensuring all underground utilities are clearly marked before work begins.
Damage caused by unmarked or unidentified utilities is the client’s responsibility.
6. Safety and Site Access
All pedestrians, pets, and personal property should be kept clear of the work area.
Access must be granted for equipment and materials as needed to complete the project.
7. Warranty Disclaimer
Unless otherwise stated in writing, all materials and workmanship are provided “as is.”
8. SMS/Text Message Communications and Consent
By providing your phone number, you consent to receive SMS/Text messages from Excavation Services by JKoschara LLC regarding quotes, scheduling, project updates, and promotions.
Message and data rates may apply.
Frequency: Not more than 4–6 messages per month.
You may opt out anytime by replying “STOP.”
Reply “HELP” for assistance.

9. Limitation of Liability
To the fullest extent permitted by law, Excavation Services by JKoschara LLC shall not be liable for indirect, incidental, or consequential damages arising from the use of our services.
10. Termination of Services
We reserve the right to terminate services or cancel a contract at any time for non-payment, unsafe conditions, or breach of terms.
11. Governing Law
These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the appropriate county courts within the State of New York.
